Utah's AI disclosure law: Utah Code § 13-77-103

Since 7 May 2025, a business using generative AI to talk to consumers in Utah has to say so when asked. Utah Code § 13-77-103(1)(a), enacted by S.B. 226 (2025), says: “A supplier that uses generative artificial intelligence to interact with an individual in connection with a consumer transaction shall disclose to the individual that the individual is interacting with generative artificial intelligence and not a human, if the individual asks or otherwise prompts the supplier about whether artificial intelligence is being used.” (Utah Code § 13-77-103(1)(a), applies from 7 May 2025). Licensed and certified occupations go further: they disclose up front when the interaction is a high-risk one.

“The individual's prompt or question under Subsection (1)(a) must be a clear and unambiguous request to determine whether the interaction is with a human or with artificial intelligence.”

Regulated occupations

“prominently disclose when an individual receiving services is interacting with generative artificial intelligence in the provision of regulated services if the use of generative artificial intelligence constitutes a high-risk artificial intelligence interaction;”

A high-risk interaction is one that collects sensitive personal information (health, financial or biometric data) or gives personalized recommendations, advice or information that could reasonably be relied on for significant personal decisions, such as financial, legal, medical or mental health advice (§ 13-77-101(5)).

The safe harbor: disclose at the outset and throughout

“A person is not subject to an enforcement action for violating Section 13-77-103 if the person's generative artificial intelligence clearly and conspicuously discloses:”

…at the outset of the interaction and throughout it, that it is generative artificial intelligence, is not human, or is an artificial intelligence assistant (§ 13-77-104(1)(a)–(b)).

Enforcement

“the division director may impose an administrative fine of up to $2,500 for each violation of this chapter;”

The provisions were first enacted in 2024 (S.B. 149, the Artificial Intelligence Policy Act) and recast by S.B. 226 in 2025; the Utah Code numbers the chapter 13-77.
